OLD LYME ZONING COMMISSION
MINUTES OF SPECIAL MEETING
Monday, July 25, 2005


The Old Lyme Zoning Commission held a Special Meeting on Monday, July 25, 2005 at 7:30 p.m. in the Auditorium of Old Lyme Middle School.  Members present were Ted Kiritsis (Chairman), Eric Fries, Jane Marsh (Secretary) Joan Bozek, and John Johnson (Voting Alternate).  Also present was Ann Brown, Zoning Enforcement Officer.

1.      Convene Meeting; announcement of voting alternates.

Chairman Kiritsis called the meeting to order at 7:32 p.m.  Mr. Johnson indicated that he has listened to the tape of the Public Hearing.  Ms. Bozek noted that she is not eligible to vote.

2.      Proposed amendment to the Old Lyme Zoning Regulations and Zoning Map to create a new District, Sound View Village District.

Chairman Kiritsis stated that Ms. Brown has noted, from comments taken at the Public Hearing, deletions or insertions in the draft Regulation.  Mr. Fries suggested reviewing these changes.

Chairman Kiritsis noted that the first change is on Page 1, encouraging shared septic systems.  He noted that this was a result of discussions between Mark Branse and Ann Brown.

Page 2, Item d – all applications will be referred to the Selectman’s office for their review Commission review and comment.  Chairman Kiritsis stated this is being deleted so that there is not an implied approval.  He acknowledged that the Selectmen may review and comment and are encouraged to.

Page 4, Item j – each room shall be used to house no more than two adults.  Chairman Kiritsis noted that this has been changed to two persons.  He noted that the same change was made to Item k.

Page 4, Item l – by a government unit has been changed to read by the Town of Old Lyme.

Page 4, Item o – community septic system, changed to shared septic system.

37.9.10 and 37.9.11 – community septic system changed to shared septic system.

Schedule C1 – community septic system changed to shared septic system.

Mr. Fries stated that there is nothing in State Statutes that would prevent the Commission from waiving the architectural review, as long as the Commission establishes some standards as to when it could be done.  He indicated that he has verified this with Attorney Branse.  Ms. Brown stated that Linda Krause has indicated that there are no AICP Planners at CRERPA, but they are expecting that some one would take the test and pass within the next few months.  She noted that they would be very willing to be the architectural reviewer.  Ms. Marsh suggested making a minor change in the future that would set criteria for waiving architectural review.  

Ms. Marsh stated that in adopting this Regulation, the Commission should state that the Town needs to show its intention to develop a plan for parking and sewage in Sound View.  She noted that she does not see effort by the Town in this regard.  Mr. Fries stated that the Parking Committee is working hard to effectuate change in regards to parking.  Ms. Marsh noted that this is for existing parking and does not address the need for additional parking.  Mr. Fries noted that the WPCA is also looking at potential sewage solutions for that area.  He indicated that the Zoning Commission will have to work with the Selectmen in determining and working toward what is needed.  Mr. Fries stated that one resolution for parking would be to change the Regulations to make parking lots an allowable use on the sites.

A motion was made by Eric Fries, seconded by Jane Marsh and voted unanimously to approve the application of the Old Lyme Board of Selectmen to amend the Old Lyme Zoning Regulations and Zoning Map to create a new district, Sound View Village District (SVVD), the area to be bounded on the north by a line 100’ north of the north side right-of-way boundary of Bocce Lane (aka Cross Road #2), on the east by the eastern side right-of-way boundary of the alleyway between Hartford and Swan Avenues, on the west by the western side right-of-way boundary of the alley between Hartford and Portland Avenues (the alleys are in the SVVD), and on the south by Long Island Sound, as proposed with the following modifications:

1.      To include the changes as shown in the draft dated July 25, 2005.
2.      In Section 37.9.10 the word “community” to be changed to “shared.”

And to find that the application is consistent with the goals and policies of the Coastal Management Act and also consistent with the Plan of Conservation and Development.

The effective date of this modification of the regulations shall be September 1, 2005.

Ms. Bozek thanked Eric Fries and the Board of Selectmen for all the work in preparing this amendment to the Zoning Regulations.

3.      Adjourn

The meeting adjourned at 8:20 p.m. on a motion by Eric Fries and seconded by Joan Bozek.  So voted unanimously.
